Annex Agreement concerning the execution of the transfer to the United Nations of certain Assets of the League of Nations, signed on

19 July 1946 Whereas the General Assembly of the United Nations, by a rcsolution adopted on 12 February 1946, and the Assembly of ,he Lcague of Nations, by a resolution adoptcd on 18 April 1946, respectively approved the Common Plan1 for the transfer to the United Nations of certain assets of the League of Nations, on the financia! conditions mcntioned in tite aforesaid Plan.

The League of Nations, represented by Mr. Sean Lester, Secretary-Gcneral, and the United Nations represrnted by M. Wlodzimierz Modcrow, Director, representative of the Secretary- General of the United Nations at Grneva, have concluded the prcsent Agreement for the purpose of determining the details of the transfcr of the ownership of tite asscts in question, apart from the financia!

Article I The transfer of rights in respect of immovable property shall relate to the following items:

La Société des Nations,

Article 1 Le transfert de droits relatifs a des immeubles portera sur les élémcnts suivants:

The servitudes constituted in favour o( the League o( Nations in the Bill o( Sale dated 7 March 1940, concluded between the Société immobiliere de la Place des Nations and the League of Nations, and the right of purchase reserved to the League of Nations.

Article 2 The transfer of rights in respect of movable property shall relate to the following iteras:

The fittings, fumiture, office equipment and books and the stock of supplies which are in the aforementioned premises and which are the property of the League of Nations;

The books and collenions of the Library;

The fittings, fumiture, office equipment and books and the stock of supplies for the use o( the Permanent Court of International Justice which are the property af the League of Nations;

The fittings, furniture, office equipment and books and the stock of supplies which are or were in the branch offices of the League of Nations and which have remained the property of the League of Nations;

Any fittings, furniture, office equipment,

books and stock of supplies which would become the property of the League of Nations in consequence of the dissolution of organizations or institutes subsidiary thereto;

The stocks of supplies held by suppliers, which are the property of the League of Nations;

The archives of the League of Nations and of the Permanent Court of International Justice;

Ali other corporeal property belonging to the League of N ations.

Article J It is understood that gi(ts ·.presented to the League of Nations by Governments, public bodies or private individuals, whether they have become part of -the buildings or whether they have retained the character of movable property, shall be transferred to the United Nations on the same terms as those on which the said gifts were presented.

Article 4 It is recalled that, in accordance with the terms of the Common Plan:

necessary committee rooms, offi.ce accommodation and other facilities connected therewith at times and on financia} terms to be agreed &om time to time between the United Nations and the lnternational Labour Organization;

The International Labour Organization may use the Library under the same conditions as other offi.cial users thereof.

Article 5 The United Nations shall assume the following obligations which the League of Nations has undertaken to transfer to the acquirers of certain of its immovable property, namely:

As provided in the Act of 2 July 1940,

by which the Republic and Cantan of Geneva sold to the League of Nations the landed property situated in the Commune of Geneva,

Petit-Saconóex district (plot 7033, sheet 4, with an area of 19 ares and 91 metres), the buyer,

in the event of re-sale, shall undertake not to exercise his right to build on the said plot otherwise than in conformtiy with the legal provisions relevant in the matter;

As provided in Article 3 of the Agreement of 20 February 1941,-between the Services industriels de Geneve and the League of Nations, obligations in respect of underground mains shall be transferred to the acquirer of the land;

As provided in Article 6 of the Arrangement of 18 July 1942, between the Swiss Postal and Telegraph Services and the League of Nations, obligations in respect of underground mains shall be transferred to the acquirer of the land.

Article 6 The movable objects transferred shall be listed in an inventory drawn up by the League of Nations and verified jointly by the United Nations at the time of the transfer. • Article 7 The transfers provided for in the present Agreement shall take place on 1 August 1946.

Article 8

In conformity with item 8 of the report by the Committee of the United Nations accompanying the Common Plan (United Nations document A/18, 28 January .1946), the United Nations shall, during the liquidation of the League of Nations, allow the latter to use without any charge the premises and the furniture and equipment with which they are provided, together with the supplies necessary for the continuation of its activities until the date of the transfer of the said activities to the United Nations or of their termination.
