11 December 1946 Annex 1 Travel and Subsistence Regulations of the lnternational Court of Justice Travel Expenses

The United Nations shall pay, subject to the conditions of these· regulations, the travel expenses of the members and of the Registrar of the International Court of J ustice, necessarily incurred on duly authorized official journeys.

The following shall be deemcd to be duly authorized official journeys:

Where the person concerned takes up residence at the seat of the Court,

A journey from his home, at the time of appointment, to the seat of the Court, in connexion with the transfer of his residence;

A return journey every second calendar year after the year of appointment from the seat of the Court to his home at the time of appointment;

A journey upon termination of appointment from the seat of the Court to his home at the time of appointment, or·.to any other place provided that the cost of the journey is not greater than the cost of a journey to his home at the time of appointment.

The abuve provisiuns apply also tu 111cm bers who take up residence in cumpliance with Article 23 of the Statute of thc lnternational Court of Justice.

Annexe 1 Reglement concernant les frais de voyage internationale de Justice Frais de voyage

L'Organisation des Nations Unies prendra

membres de la Cour internationale de Justice et le Greffier auront du engager a l'occasion de voyages ofliciels dument autorisés.

Seront col"lsidérés comme voyages officicls dumc11t autorisés:

a) Lorsque I'intéressé fixe sa résidence au siege de la Cour,

i) Un voyage du lieu de son domicile, au momcnt de sa nomination, au siege de la Cour, motivé par le changement de résidcnce;

compter de l'année de sa nomination, un Cour et le lieu 011 il était domicilié a l'époque de sa nomination;

iii) A la cessation de ses fonctions, un vuyage du siege de la Cour jusqu'au Iieu 011 il était domicilié a l'époque de sa nominatiou, ou a tout autre endroit si le cout de ce dernier voyage ne dépasse pas celui du voyage au lieu 011 il était domicilié a l'épo que de sa nominatio11.

Travel expenses shall comprise actual transportation costs by ordinary first class transport on railroads, airlines, steamboat, and other usual means of conveyance, and shall include expenses normally incidental to transportation, e.g., taxicab fares from station, et cetera. The cost of transportation of baggage in excess of weight or size carried free by transportation companies will not be allowable as an expense unless the excess is necessarily carried for official business reasom.

!J· Ali travel will be by the most direct route, provided that travel by other routes may be allowed under written authority of the President when the official necessity therefore is satisfac .. torily established, but in other cases the travel expenses and subsistence allowance payable shall not exceed the amounts which would have been payable had the journey been by the most direct route. A per diem allowance in lieu of subsistence expenses shz.ll be paid to memben of the Court and to the Registrar while in offi.cial travel status under Regulation 1 (a) (i), 1 (a) (iii), 1 (r) or 1 (d) above. The per diem will be regarded as covering ali charges for meals, lodging, fees and gratuities, and other personal expenses.

The rates of subsistence allowance shall be for each period of twenty-four hours after the time of departure:

For the President $25 (U. S.), or the equivalent thereof in other currency;

For other members of the Court $20 (U. S.), or the equivalent thereof in other currency;

For the Registrar $15 (U. S.), or the equivalent thereof in other currency, provided that where he accompanies a member of the Court he shall receive $20 (U. S.), or the equivalent thereof in other Cl'rrency.

Where óe traveller receives either full subsistence (i.e., breakfast, lunch and dinner) or accommodation (hut not both), the cost of charge résident avec lui au siege de la Cour,

Cette indemníté de subsisfrais de nourriture, de logement, frais divers et pourboíres, et autres dépenses personnelles.

Les taux de l'indemnité de subsistance seront fixés comme suit pour chaque période de vingt-quatre heures a compter de l'heurc du départ:

a) Pour le Président, 25 dollars (E.-U.) ou la contre-valeur en monnaie d'autres pays;

(a) Where a member of the Court or the Registrar, undertak.ing an official journey, is accompanied by his wife and/or dependent children, under Regulation 1 (a) (i) or 1 (a) (iii) a subsistence allowance of one-half of the appropriate rate payable to the member of the Court or to the Registrar in respect of that journey will be; payable in respect of eacb dependent;

Where dependents are travelling unaccompanied on an authorized journey under Regulation 1 (a) (i) or 1 (a) (iii), the full rate of aubsistence allowance will be payable in respect of one adult and one-half of that rate to each other dependent.

The claims ahould show every item of expense except where aucb expenses are to be covcred by a aubsistence allowance, and every advance drawn from any United Nations source, and must, as far as possible, be supported by receipta ahowing the service to whicb the payment ia related. Ali expenses must be ahown in the actual currency in whicb they were made and must be certified as having been necessarily and solely incurred in the discbarge of the official busineaa of the Court.
