Requests Member States:

To take effective measures to safeguard the human rights and fundamental freedoms of the abovementioned persons;
( b) To ensure, in particular, that s1;1ch persons are not subjected to torture or other cruel, mhuman or degrading treatment or punishment;

Also to ensure that such p~rsons, in the ~etermination of any criminal charge agamst them, :ecelVf: a fair hearing by a competent, independent and 1mpartial tribunal established by law;

Calls upon Member States to examine periodically the possibility of releasing such persons as an act of clemency or by way of conditional release or otherwise.
