Section 9

The hcadquartcrs distrïct shall be inviolable. Federal, ;tatc or local officcrs or officiais of the United States, whether administrative, judicial, military or police, shall not enter the headquarters district to perform any official duties therein ex• cept with the consent of and undcr conditions agreed to by the Secretary-General. The service of legal process, including the seizure of private property, may take place within the headquarters district only with the consent of and under conditions approved by the Secretary-Gcneral.

( b) Without prejudice to the prov1S1ons of the General Convention or article IV of this agreement, the United Nations shall prevent the headquarters district from becoming a refuge either for persons who are avoiding arrest under the federal, state, or local law of the United States or are required by the Government of the United States for extradition to another country, or for persons who are endeavouring to avoid service of legal process.

Section JO The United Nations may expel or exclude persons from the headquarters district for violation of its regulations adopted under section 8 or for other cause. Public services and protection oi the headquarters district Section 17

The appropriate American authorities will exercise, to the extent rcquested by the Secretary- General, the powers which they possess to ensure that the headquarters district shall be supplied on equitable terms with the necessary public services. including electricity, water, gas, post, telephonc, telegraph, transportation, drainage, collection of refuse, fire protection, snow removal, et cetera. In case of any interruption or threatened interruption of any such services, the appropriate American authorities will consider the nceds of the United Nations as being of equal importance with the similar needs of essential agencies of the Government of the United States, and will take steps accordingly to ensure that the work of the United Nations is not prejudiccd.

Section 18 The appropriate American authorities shall take ail reasonable steps to ensure that the amenities of the headquarters district arc not prejudiced and the purposes for which the district is rcquired arc not obstructed by any use made of the land in the vicinity of the district. In making supplemental agreements with the Secretary-General, the United States shall consult with the appropriate state and local authorities. If the Secretary-General so requests, the Secretaryof State of the United States shall appoint a special rcprcscntative for tlw purpose of liaison with the Secretary-Gencral. Maintenance of utilities and underground construction

The Secrctary-General agrees to provide passes to duly authorized employees of the City of New York, the State of New York, or any of their agencies or sub-divisions, for the purpose of enabling them to inspect, repair, maintain, reconstruct and relocate utilities, conduits, mains and sewers within the headquarters district.

Section 2 Underground constructions may be undertaken by the City of New York, or the State of New York, or any of their agencies or sub-divisions, within the headquarters district only after consultation with the Secretary-General, and under conditions which shall not disturb the carrying out of the fonctions of the United Nations.

Noting what has so far been done in the matter of the surrender and punishment, after due trial, of the war criminals referred to in its resolution

adopted on 13 Fcbruary 1946' Reaffirms the aforementioned resolution;

Reaflirms also its resolutions on the subject of rcfugees adopted on 12 February 1946 2 and on 15 December 1946;

Recommends Members of the United Nations to continue with unabated energy to carry out their responsibilities as regards the surrender and trial of war criminals;

Recommends Members of the United Nations, which desire the surrender of alleged war criminals or traitors ( that is to say nationals of any State accused of having violated their national law by treason or active collaboration with the enemy during the war) by other Membcr8 in whose jurisdiction they are believed to be, to request such surrender as soon as possible and to support their request with sufficient cvidence to establish that a reasonable prima f acie case exist.s as to identity and guilt, and

ANNEXE 2 Entretien des services d'utilité publique et constructions souterraines

Le Secrétaire général convient de fournir des laissez-passer aux employés dûment autorisés de la Ville de New-York, de l'Etat de New-York ou de toute agence ou circonscription de ladite Ville ou dudit Etat, en vue de permettre à ces employés d'inspecter, réparer, entretenir, reconstruire les services d'utilité publique, canalisations, collectérieur du district administratif. Section 2 La Ville de New-York ou l'Etat de New-York ou leurs agences ou circonscriptions ne pourront entreprendre des constructions souterraines à l'intérieur du district administratif qu'après r:onsulà ne pas troubler l'accomplissement des fonctions de l'Organisation des Nations Unies.
